Article 1 – Legal Notice

The Nation application is published by NatScale, a simplified joint-stock company (SAS) with a share capital of €4,000, registered with the Thonon-les-Bains Trade and Companies Register under number 941 471 492. Its registered office is located at 306 route de l’Usine, 74140 Sciez, France. The intra-community VAT number is FR13941471492. The publication director is Mr. Pierre Aliaga, Chief Executive Officer.

The application is hosted by Supabase, with its registered office at [address to be specified]. Certain features rely on third-party providers, notably Mapbox for geolocation services. Users may contact NatScale for any questions or complaints via email at interne@nation-startup.com or by postal mail at the registered office.

This article aims to ensure transparency and compliance with Articles 6 and 6-II of French Law No. 2004-575 of June 21, 2004, on confidence in the digital economy (LCEN), which require clear information about the publisher and host of an online service.

Article 2 – Purpose

These Terms of Use (TOU) govern all relationships between NatScale and users of the Nation application. The service allows the creation of public profiles, content sharing, private messaging, geolocation, and connections between users.

This platform is primarily intended for French startup founders but is accessible internationally. Acceptance of the TOU is mandatory to access and use the application. Any violation of these terms may result in the suspension or deletion of the user account.

Article 3 – Access to the Service

Access to the application is reserved for individuals aged 15 years or older. Minors under 15 must obtain the authorization of their legal representative, in accordance with Article 8 of the GDPR and Article 388-1 of the French Civil Code.

The application is available on iOS via TestFlight and can be used in French or English. Access to the service is free of charge. Certain affiliate offers may be proposed, but they do not affect the free availability of the main features.

NatScale reserves the right to limit or suspend access in case of maintenance or non-compliance with these Terms of Use.

Article 4 – Account Creation and Security

To create an account, the user must provide:

  • A valid email address,

  • A secure password (at least thirteen characters, including letters, numbers, uppercase letters, and special characters),

  • Their real first and last name.

It is also possible to complete the profile with a photo, banner, profile title, and description. Account verification is carried out by sending a confirmation code to the provided email address.

Multiple accounts are not allowed. In cases of inactivity exceeding thirty days, the account may be removed from the application’s visibility map. Each user is responsible for maintaining the confidentiality of their login credentials and the security of their account. Login data are recorded in accordance with Articles 1366 and 1367 of the French Civil Code and may be used as evidence in the event of a dispute.

Article 5 – Features and Content

The application allows:

  • The creation of profiles visible to all users,

  • Sharing of posts,

  • Private messaging,

  • Uploading of files and external links,

  • Use of geolocation for certain features.

All content posted is considered visible to all users. Content is categorized and recommended based on geographic proximity and the topics provided. The user can disable location sharing at any time.

By publishing content, the user grants NatScale a non-exclusive, worldwide, and free license, limited to the technical use necessary for the operation and display of the service. This license ends upon deletion of the account or the relevant content.

Article 6 – Moderation and User Responsibilities

Each user is responsible for their posts. NatScale reserves the right to remove any content or permanently suspend an account without notice or justification in the event of non-compliance with the Terms of Use.

Users may contest a moderation decision by contacting interne@nation-startup.com. NatScale complies with the obligations of the Digital Services Act (EU Regulation 2022/2065). The competent authorities are ARCOM for content and CNIL for personal data.

Any inappropriate behavior or violation of the law may result in the permanent deletion of the profile.

Article 7 – Personal Data and Privacy

NatScale collects only the data strictly necessary for the operation of the service: email, password, first and last name, location, profile picture, banner, profile title, and description. Geolocation is provided via the Mapbox API. Technical logs are retained for the legally required period.

Users have the right to access, rectify, erase, restrict, port, and object to their data, in accordance with the GDPR. Links to affiliated partner websites may trigger trackers managed by those partners. NatScale has no control over these trackers, and their processing is governed by the privacy policies of the third-party sites.

Article 8 – Code of Conduct

It is prohibited to publish content that is defamatory, insulting, discriminatory, hateful, violent, pornographic, illegal, or infringes the rights of others. Impersonation, harassment, spam, scraping, introducing viruses, or any circumvention of security measures is strictly forbidden.

Violations of these rules will result in the immediate and permanent deletion of the account, without notice or compensation.

Article 9 – Intellectual Property

NatScale owns all intellectual property rights related to the application, including its trademarks, logos, graphic elements, and software. Users agree not to infringe upon these rights. Scraping or automated data extraction is strictly prohibited, except as permitted under Article L122-5 of the French Intellectual Property Code.

Article 10 – Availability and Support

NatScale makes its best efforts to ensure service availability but does not guarantee uninterrupted access. As the application is in beta version, malfunctions may occur.

Article 11 – Liability

The service is provided “as is.” NatScale disclaims all liability for indirect damages, data loss, or loss of revenue. As the service is free, no financial compensation may be claimed. Each user indemnifies NatScale against any claims related to their content.

Article 13 – Changes to the Terms of Use

NatScale may modify the Terms of Use at any time. Users will be informed via an in-app notification or email. Continued use of the application constitutes acceptance of the new terms.

Article 14 – Applicable Law and Dispute Resolution

The Terms of Use are governed by French law. Any dispute falls under the jurisdiction of the French courts. For consumers, the court of their residence or the registered office of NatScale may be chosen. A consumer mediator will be appointed. Users may also access the European ODR platform: https://ec.europa.eu/consumers/odr.

Article 15 – Final Provisions

If any provision is declared invalid, the remaining provisions shall remain applicable. The fact that NatScale does not enforce a provision at a given time does not constitute a waiver of future enforcement.
